Terms of Service

By using eRecordingExperts.com to request eRecording, you (“Client”) acknowledge that you understand and agree to these Terms of Service:

eRecording Experts, Inc, a California Corporation (”Submitter”) shall provide document recording services at the county recorder that is indicated in your request. Submitter will use its best efforts to perform the services in a timely manner.

eRecording Service Fee: The Submitter Service fee per document is $45.00 and is due and payable upon receipt of order. In addition, a County Recording Fee and taxes (if any) will be due once recorded. Rates are subject to change.

Rejected Documents: There is no additional eRecording Service Fee for the first resubmission of rejected documents. However, thereafter, each re-submission of the same document will incur a courtesy discounted rate of $25 eRecording Handling Fee.

Payment: County recorder fees are due immediately upon receipt of invoice. Non-Attorneys are required to make full payment of all eRecording Fees up front. There is no mark-up of county recorder fees. Client is required to store a preferred means of payment with Submitter. Visa, Mastercard, American Express are accepted (and may be subject to a 3% service fee). Client can avoid the 3% service fee by storing Bank Account information for ACH with Submitter. Client’s chosen payment method will be automatically billed the same day the documents are recorded. (If the total transaction exceeds $500, the Submitter may request an additional down payment and a 3% service fee will be charged unless paid by ACH.) Checks are acceptable means of payment subject to credit approval. If Client uses ACH, a direct link will be emailed to Client via Quickbooks Online with the safety of encryption.

Chargebacks/Dishonored Payments: All returned Non-Sufficient Funds or dishonored payments will incur a 15% penalty, plus $35 handling charge for each transaction.

Document Review: Submitter will review each document at no cost. There is no guarantee that the document will be accepted by the county recorder.  The client is responsible for the content of the document and the formatting of the document. Submitter encourages Client to review each document carefully. If Client fails to discover a defect causing a rejection, Submitter will make one re-submission at no additional cost.

Original Documents: All documents must be original with a wet ink signature and/or notarization. Submitter will accept documents with remote online notarizations that have been executed in accordance with the notary laws of that State. Client is required to deliver or mail the original documents to eRecording Experts at its corporate office in Oceanside, CA. Only the Submitter is authorized to scan and submit documents electronically.

Fraud Prevention: If Client is not named in the document or does not have a proven licensed capacity then please understand our effort to prevent fraudulent submissions for county recordings. eRecording Experts, Inc. may request a state-issued photo ID for BOTH the Client and the credit card holder. If you cannot provide both, we will be unable to submit your documents.

Mailing Documents: It is expected that Client will USPS mail/FED EX/GLS/UPS the documents with a tracking number and provide a return shipping label. Delivery will be at the Oceanside, CA location. Please review our website for addresses. (Ship to address differs based on what service Client uses to ship.)

Mobile Services:  Mobile service is available in North San Diego County (only) for a minimum courier fee. Please email [email protected] to request a quote. Submitter is a bonded Professional Photocopier so is qualified to provide this mobile service.

Filing Delays: Delays are uncommon, but may occur due to natural disasters, fires, civil disturbances, disruption of telecommunications, transportation, utilities, services or supplies, government action, computer disruption, data corruption, incompatible or defective equipment, software or services, and other reasons. Submitter will not be liable for any damages or loss resulting from any delays of service.

Governing Law: This agreement shall be governed by the laws of the State of California. Should a legal action be brought, the Parties exclusively and irrevocably agree that it shall be instituted in a state or federal court in San Diego County, California. The prevailing party in any legal action shall have the right to collect from the other party its reasonable costs and attorneys’ fees incurred in enforcing this agreement. CLIENT ACKNOWLEDGES THAT USE OF eRecording Services IS AT THE SOLE RISK OF THE CLIENT. THE SUBMITTER MAKES NO WARRANTY OR REPRESENTATIONS TO CLIENT REGARDING THE ACCURACY OR COMPLETENESS OF ANY INFORMATION OR DOCUMENTS PROVIDED BY CLIENT. SUBMITTER DOES NOT WARRANT TO CLIENT THAT THE RECORDING SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

By using our service and checking the box on the order form, the undersigned agrees to the foregoing terms and conditions and authorizes Submitter to establish an account, provide services, and charge all applicable fees.
